Do you know what a SIRP is?

SIRP Stands for State-Sponsored Inspection and Dispute Resolution Process (SIRP).  The Texas Residential Construction Commission (TRCC) was formed with the passage of HB730 in the 78th Texas Legislature.  The legislation laid out the SIRP process and the TRCC implemented, by rule, the details that formed the SIRP.  There were some key modifications made by HB1038 in the 80th Texas Legislature.  The process was designed to give homeowners and home builders a procedure to resolve post-construction defects in homes.

Bottom line....Both the builder and homeowner want to get the house fixed!

Are you now thoroughly confused?

CRS understands the process and the steps that must be taken to successfully 
navigate the process in a manner which meets everyones objectives.


Do you know that the first step in the process is when the builder receives a 30 day notice from the homeowner?  The homeowner MUST give a 30 day written notice to the builder of any alleged construction defect(s).

What should you, as a builder, do when you receive that notice

A- Panic?

            You can, but that won't help much.

B- Throw the notice away and hope nothing happens? 
            You can, but be assured, some things will happen and most of them
            won't be good for you.

C- Respond as per the procedures set out by the TRCC.
            Yes!  This is what you should do!

CRS will:

  • Notify your Third Party Warranty Company

  • Notify your CGL Agent & Carrier

  • Keep you informed about the critical dates that the TRCC has established 

  • CRS will send an Independent Inspector to your job to inspect the alleged defects that the homeowner pointed out in the 30 day notice letter.
  • With that inspection report, CRS will have an "Offer to Repair" written that can be given to the homeowner prior to the end of the 30 day notice period. This is very important (see below).
     
  • If the homeowner rejects that "Offer to Repair" and files a SIRP with the TRCC, CRS can represent you at the inspection or attend the inspection with you if desired. 

The Following is from HB1038 of the 80th Texas Legislature

SECTION 40.  Sections 428.001

(e)  The commission may not require a builder to reimburse
   fees or inspection expenses under this section if, before the
   inspection, the builder offered to make repairs or have repairs
   made substantially equivalent to those required by the findings of
   the final report confirming the defect requiring repair.
(f)  If, before the inspection, the builder has made or
   offered to make repairs substantially equivalent to those required
   by the findings of the final report confirming the defect, the
   agency may not list the finding on the commission's Internet
   website.
